Murta and Mildred Murta tome personally well known as the parsons whose names appear upon the within and foregoing deed of conveyance as the parties Grantors and stated that they had executed the same for the consideration and purpose therein mentioned and seteforty, and I do hereby so certify. - And I further certify that on the same day voluntarily appeared before me Mildred Murta, wife of the said Frank B. Murta, to me well known to be the person whose name appears upon the within and foregoing deed, and, in the absence of her said husband, stated and declared that she had of her own free will executed said deed and had signed the relin- quishment of dower and homestead therein expressed for the purposes and consideration therein contained and set forth, without compulsion or undue influence of her said husband. Fee: $2.00 3531—I C\M WHEREAS a petition was duly filed with the City Council of the City of Van Buren, Ark- ansas, on the 4th day of October, 1948, asking the City Council to vacate and abandon all that portion of Weaver Street designated on the plat of Fairmount Addition to said city, now appearing of record at page 17 in the Plat Book of Crawford County, in the office of the recorder of Crawford County, between Poplar Street on the South and the right of way of the St. Louis -San Francisco Railway Company on the North; -WHEREAS after due notice, as required by law, the council has, at the time and place mentioned in the notice', heard all persons desiring to be heard on the question and has ascertained that the portion of said street hereinbefore described has heretofore been dedi- cated to the public use as a street; has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the property abutting upon the portion of said street sought to be vacated have filed with the council their written consent to such abandonment and that the public interest and welfare will not be adversely affected by the abandonment of said portion of said street; NOW, THEREFORE, be it ordained by the City Council of the City of Van Buren, Arkansas: Section 1. The City of Van Buren, Arkansas, hereby releases vacates and abandons all its rights, together with the rights of the public generally in and to.that portion of Weaver Street between Poplar Street on the South and the right of way of the St. Louis San - Francisco Railway Company on the North, said street being 60 feet wide and 150 feet long, more or less, and being bounded by Lots 5, 6, and 7 of Block 11, Fairmount Addition to the Original City of Van Buren on the West and by Lot 9, Block 10, Fairmount Addition to the City of Van Buren on the East, said street being more particularly described as follows: Beginning at the.Southwest corner of Lot 9, Block 10, Fairmount Addition to the City of Van Buren, Arkansas, thence North approximately 150 feet to the Northwest corner of said Lot 9, Block 10; thence Southwesterly along the right of way line of the St. Louis -San Francisco Railway Company to the Northeast corner of Lot 5, Block 11, Fairmount Addition to the original town of Van Buren, Arkansas; thence South South along the East boundary line of Lots 5, 6, and 7, Block 11 of said Addition to the Southeast corner of Lot 7,.in•said Block 11; thence East along the North boundary of Poplar Street to place of beginning. Section 2. A copy of the ordinance; duly certified by the City Clerk shall be filed in the office of the recorder of the County and recorded in the deed records of said County. Section 3.
