ORD NO 07-2008 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. I -2008 CO BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS AN ORDINANCE TO BE ENTITLED: AN ORDINANCE TO AMEND THE VAN BUREN MUNICIPAL CODE TO CHAPTER 2.44 (ORDINANCE 04- 1981,AS IN LIGHT OF THE ADOPTION OF THE VAN BUREN CIVIL SERVICE REGULATIONS, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. WHEREAS, the City adopted Ordinance 04 -1981 to establish the Van Buren Police Department and to establish certain rules and regulations pertaining to the operation of that department; and WHEREAS, the City subsequently adopted Ordinance 17 -1992 to establish the Van Buren Civil Service Commission, thereby making certain provisions of Ordinance 04 -1981 redundant, conflicted and/or confusing; and WHEREAS, there is an immediate need for these amendments to Ordinance No. 04 -1981 for the health, safety, and welfare of the citizens of Van Buren. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT: SECTION 1: Ordinance No. 04 -1981, as amended (Van Buren Municipal Code2.44.01 et. seq.) shall be amended as follows: Sections 2.44.02 through 2.44.10 shall be deleted and the following sections shall be added following SECTION 2.44.01: SECTION 2.44.02: The Mayor and Chief of Police are authorized pursuant to Ark. Code Ann. k; 14 -52 -101 to adopt and implement internal rules. regulations. and policies pertainine to the operation of the Citv of Van Buren Police Department. to the extent such provisions are not in conflict with the Van Buren Civil Service Ordinance or state law. SECTION 2.44.03: All employees of the city. including those within the civil service commission shall be subject to any rules regulations or personnel _policies adopted by the city_ to the extent such provisions are not in conflict with the Van Buren Civil Service Ordinance or state law. Section "2.44.11" shall be renumbered as "2.44.04." 0 SECTION 2: The passage and approval of these amendments to the Van Buren Ordinance 04 -1981 will protect the heath, safety, and /or welfare of the City and its citizens. Therefore, an emergency is declared to exist and this Ordinance, being necessary for the preservation of the public health, safety and /or welfare shall be in full force and take effect immediately upon and after its passage. SECTION 3: The various provisions and parts of this Ordinance are hereby declared to be severable, and, if any section or part of a section, or any provision or part of a provision herein, is declared to be unconstitutional, inappropriate, or invalid by any court of competent jurisdiction, such holding shall not invalidate or affect the remainder of this Ordinance and to that extent the provisions hereto are declared to be severable.
